Conservation/Restrictive Covenant or Right-of-Way


To fulfill the minimum safeguarding requirements of an Ecosystem Development Plan (EDP), registration of a combined Conservation/Restrictive Covenant or Right-of-Way (RC/ROW) for the property can be completed to ensure safeguarding and maintenance of the Protection Area in perpetuity.

RC/ROW are agreements made usually between a property owner and government agency (e.g., a municipality) that will identify “no disturbance” and “maintenance access” areas within the property. Restriction of land use or activities within designated Protection Areas are implemented for the protection of riparian areas and other environmental features.

Provisions for post-construction management and monitoring (e.g., P-15 Agreement), and a compensation plan to determine landscape bonding can be prepared by our environmental staff. Security requirements for installation and maintenance purposes will be required to ensure that all aspects of the RC/ROW agreement are maintained, and can also be provided to the Client.
