City of Delta's New Development Application Procedures Bylaw

The City of Delta has approved a new Development Application Procedure Bylaw, to replace the previous Development Application Procedures Bylaw adopted in 1992, to streamline the development application process.

General updates to the bylaw include:

  • Removing detailed application requirements from the bylaw in favour of application requirements that are in a form specified by the General Manager of Development;
  • Requiring public notice signs for a limited number of application types such as Official Community Plan and Zoning Bylaw amendments; and
  • Eliminating the requirement for mail notification for development permit applications, which are generally of a more technical nature.

The new Bylaw would delegate to staff the decisions with a more technical and administrative aspect, including:

  • Issuing and/or amending a broader range of development permits;
  • Issuing and/or amending temporary use permits;
  • Issuing and/or amending variances to the Sign Bylaw;
  • Issuing and/or amending minor development variance permits. A minor development variance could include varying height, setbacks, lot coverage, and off-street parking requirements;
  • Issuing heritage alteration permits;
  • Amending development application notice sign requirements; and
  • Executing legal documents required as a condition of council approval, such as entering into legal agreements, covenants or statutory right-of-ways.

The newly proposed bylaw aims to expedite the development of homes and other community projects by accelerating the review process, and reducing the number of procedural steps required to obtain application approval.
